Biomodality (“Biomodality,” “we,” “our,” or “us”), a subsidiary of Tefani, provides biometric verification services through our API. We are committed to protecting the privacy and security of end users’ biometric data and ensuring that it is processed only for the purpose of identity verification on behalf of our clients (“Clients”).

This Privacy Policy explains how we handle, process, store, and protect biometric data and other information.

1. Scope

This Privacy Policy applies to the biometric verification services provided by Biomodality via our API. Our Clients integrate our API into their applications or systems and submit end users’ biometric information (“End User Data”) for identity verification purposes.

2. Information We Collect

When our Clients use our API, we process the following information:

Biometric Data: Biometric identifiers (e.g., facial features, voiceprints, or other biometric modalities) provided by our Clients on behalf of their end users.
Technical Data: Metadata necessary to operate our services securely (e.g., timestamps, request logs, and API usage details).

We do not collect or have access to any additional end user information beyond what is provided by our Clients.

3. Purpose of Processing

Biomodality processes End User Data solely for the purpose of verifying identity on behalf of our Clients. We do not use biometric data for any other purpose, including but not limited to:

Identifying individuals outside the verification request.
Training, testing, or developing artificial intelligence models.
Marketing, profiling, or advertising.
Selling or sharing data with third parties.

4. Data Retention

End User Data is securely stored for up to three (3) days after submission.
Retention is strictly for processing and troubleshooting purposes (e.g., investigating failed verifications or system errors).
After three days, biometric data is permanently deleted from our systems.

5. Data Security

We use industry-standard security measures to protect End User Data, including but not limited to:

Encryption in transit and at rest.
Access controls and authentication mechanisms.
Network monitoring and intrusion detection.
Strict internal policies limiting employee access to End User Data.

6. Data Sharing

Biomodality does not share, sell, or disclose End User Data to third parties except in the following limited circumstances:

With Client: Results of biometric verification are returned only to the Client that initiated the request.
Legal Compliance: When required to do so by law, court order, or other legal processes, provided such disclosure is lawful.

7. Client Responsibility

Our Clients act as the data controllers for End User Data. Clients are responsible for:

Obtaining appropriate end user consent before submitting biometric data to Biomodality.
Complying with applicable privacy and data protection laws in their jurisdiction.

Biomodality acts as a data processor, processing data only under the instructions of its Clients.

8. End User Rights

As the processor, Biomodality does not interact directly with end users regarding their biometric data. End users should contact the Client (the data controller) to exercise any privacy rights (e.g., access, correction, deletion).

9. International Data Transfers

Biomodality operates on a secure global network, which may involve processing End User Data in different jurisdictions. If a Client has specific restrictions or requirements regarding international data transfers, it is the Client’s responsibility to notify Biomodality in advance. We will work with the Client to accommodate such restrictions and ensure compliance with applicable data protection regulations.

10. Changes to This Privacy Policy

We may update this Privacy Policy from time to time. Updates will be posted on our website with the “Last Updated” date. Continued use of our services after updates indicates acceptance of the revised policy.
